Amaneunsis Monday: George Schwalls - Another Indenture/Promissory Note/Mortgage

 The following was found in Johnson County, Georgia, Deed Book G, pages 502-503.  


 (You may click on the images of the original to have a larger view of them.  There were three words I could not transcribe.  I think I did a pretty good job considering the atrocious handwriting of the courthouse clerk!)

Johnson County  {This indenture made this the
                            16th day of May 1887, between Mary
                            Jane Schwall & George Schwalls
both of said county state of the first part | Don.
ovun & Perkins of the County of Jefferson said state
of the second part; Witnesseth hath the parties of the
first part for & in consideration of the sum of one
dollar to them in hand price at & before its sealing
& advisory of these present, as well as to secure the
payment of the following notes to with - one note for seven-
ty dollars due January 1st 1888. - one note for seventy five
Dollars due January 1st 1887. one note for seventy five
dollars due January 1st 1890 - all dates March 4th
1887. and one note for ninety Eighth & no/100 dollars due
January 1881 dated May 6th 1887 all of said notes bear-
ing Eight per cent Interest after Maturity once
given for the purchase money of the Land
herein described, ____ ___ ______ sold & con
veyed by those presents - do bargain sell & con-
vey unto the parties of the first part their heirs &
assigns one tract of Land in the county of Johnson
said state - known and part of the Aaron Barber
grant on the Little Ohoopie creek & on both sides of
McGendes Creek - adjoining Lands of Columbus Josey
Jno Williams Jno Brady & Allen Minks conveyence
by Jno Williams to Donovan & Perkins & containing
three hundred & fifty-acres more or less.  As de-
scribed in deed by Donovan & Perkins to George Schwall
& Mary Jane Schwall.  Made this May 16th 1887.
  To have and to hold the said Land with all appen-
tenanus thereunto belonging - forever in fee simple
But should the said George Schwall  & Mary Jane
Schwall pay or cause to be paid to the parties of the
second part their heirs or assigns - the amount due
on notes herein before described & ten per cent of
Attorneys fees - should same be collected by pro-
cess of Law Then this deed of Mortgage to be void else
of force.
  Witness our hand & seal this the 16th day of May 1887.
  Signed sealed & delivered in presence of us.
